Foreign companies that process data of individuals in Switzerland in connection with the trade of goods or services, or for the purpose of monitoring behavior, must appoint a representative in Switzerland.
A representative must also be appointed if the data processing is extensive or regular, or involves a high risk to the personality of the data subjects. For Swiss companies, the appointment of a data protection officer is voluntary.
