Foreign companies that process personal data in Switzerland in connection with the trade in goods or services or for the purpose of monitoring behavior must designate a representative in Switzerland.
A representative must also be appointed if the data processing is extensive or regular or involves a high risk to the privacy of the data subjects. The appointment of a data protection officer is voluntary for Swiss companies.
